Baldwin Ventures LLC DBA Simmer AI ("Simmer AI," "we," "our," or "us") is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our mobile application and website (collectively, the "Services"). Please read this policy carefully.

1. Information We Collect

Information you provide directly

• Account data: Name, email address, and password when you create an account.
• Profile data: Display name, profile photo (optional), food preferences, dietary restrictions, love language, relationship status, and anniversary date.
• Partner pairing: The invite code you exchange with your partner to link your accounts.
• AI conversations: Messages you send to our AI agents (DinnerSync, Date Night, Spark, Memory Keeper, Gift Agent, Travel Agent, Communication).
• Memories and content: Notes, memories, and other content you choose to save in the app.
• Payment information: Billing details are processed by Apple App Store or Google Play — we do not store your payment card details.

Information collected automatically

• Device data: Device type, operating system version, app version, unique device identifiers.
• Usage data: Features used, screens visited, session duration, crash reports and error logs.
• DinnerSync data: Your swipe history and matches (shared with your linked partner only).

Information we do not collect

• We do not collect your precise GPS location unless you explicitly grant location permission for features that require it (e.g., local restaurant suggestions).
• We do not access your contacts, photos, or camera without your explicit permission.
• We do not collect biometric data.

2. How We Use Your Information

We use the information we collect to:

• Provide, operate, and improve the Services
• Personalize your experience and the AI agents' responses
• Process transactions and send related information (receipts, subscription confirmations)
• Send service-related notifications (e.g., DinnerSync matches, partner invitations)
• Respond to customer service requests and support inquiries
• Monitor and analyze usage patterns to improve the app
• Detect and prevent fraudulent or unauthorized activity
• Comply with legal obligations

We do not use your personal AI conversations to train AI models. We do not sell your personal data to third parties.

3. How We Share Your Information

With your partner

When you pair with a partner in Simmer, certain data is shared between your accounts: your display name, profile photo, food preferences, DinnerSync swipes and matches, and any shared memories or content you create together. You control what you share.

With service providers

We work with third-party service providers who assist in operating our Services:

• Supabase: Database and authentication infrastructure
• Anthropic: AI model provider powering our agents. Your messages are sent to Anthropic to generate responses, subject to Anthropic's privacy policy and data processing agreement with us.
• Apple / Google: App distribution and in-app purchase processing
• Analytics providers: Aggregated, anonymized usage analytics

These providers are contractually required to process data only on our behalf and in accordance with our instructions.

Legal requirements

We may disclose your information if required by law, court order, or governmental authority, or to protect the rights, property, or safety of Simmer, our users, or the public.

Business transfers

In the event of a merger, acquisition, or sale of assets, your information may be transferred. We will provide notice before your personal data is transferred and becomes subject to a different privacy policy.

4. Data Retention

We retain your personal data for as long as your account is active or as needed to provide the Services. You may delete your account at any time from Me → Settings → Delete Account. Upon deletion, your personal data is removed within 30 days, except where retention is required by law.

AI conversation history is retained for 90 days to enable contextual conversations, then automatically deleted.

5. Your Rights

Depending on your location, you may have the following rights regarding your personal data:

• Access: Request a copy of the personal data we hold about you.
• Correction: Request correction of inaccurate or incomplete data.
• Deletion: Request deletion of your personal data (subject to legal obligations).
• Portability: Request a machine-readable copy of your data.
• Objection: Object to our processing of your data for certain purposes.
• Restriction: Request that we restrict processing of your data in certain circumstances.

6. Children's Privacy

Simmer is not intended for children under the age of 13 (or 16 in the European Economic Area). We do not knowingly collect personal data from children. If you believe we have inadvertently collected data from a child, please contact us immediately and we will delete it.

Your information may be processed and stored in the United States and other countries where our service providers operate. By using Simmer, you consent to the transfer of your information to these countries, which may have different data protection laws than your country of residence.

8. Security

We implement industry-standard technical and organizational measures to protect your personal data against unauthorized access, alteration, disclosure, or destruction. These include encryption in transit (TLS), encryption at rest, access controls, and regular security reviews.

No method of electronic transmission or storage is 100% secure. We cannot guarantee absolute security, but we take reasonable steps to protect your information.

Our Services may contain links to third-party websites or services. We are not responsible for the privacy practices of those third parties. We encourage you to read their privacy policies before providing any personal information.

We may update this Privacy Policy from time to time. We will notify you of material changes by posting the new policy in the app and updating the "Last updated" date above. Your continued use of the Services after any changes constitutes your acceptance of the updated policy.
